Terms of Use
These terms are an agreement between you and Subsense OÜ (Subsense Interactive, “we”), the developer and publisher of Strike Pad (“the game”). By downloading or playing the game you accept them. If you do not, please do not use the game.
1. The licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the game on any Apple-branded device you own or control, as the Usage Rules in Apple’s Media Services Terms and Conditions allow (including use by other accounts in your Family Sharing group, where the game allows it). You may not copy, modify, sell, rent, lend or distribute the game, or decompile, reverse-engineer or disassemble it, except as the law expressly allows despite this restriction.
2. Purchases
Anything you buy in the game is bought through Apple’s App Store, under Apple’s terms. Refunds are Apple’s to decide, under its policies.
3. Your conduct
Use the game lawfully and as it is meant to be played. Do not try to interfere with it, or with anyone else’s use of it.
4. Our content
The game, its story, characters, art, music, footage and code belong to Subsense OÜ or its licensors. The Saltreach, its powers, its people and its war are invented: no real country, flag or conflict is portrayed.
5. Privacy
How the game and this website handle information is set out in our Privacy Policy.
6. Updates and changes
We may update the game, and change or end any part of it. We may change these terms; the date at the top shows the latest version, and continuing to use the game after a change means you accept it.
7. Warranty and liability
The game is provided as it is, and we do not promise it will be free of errors or always available. Nothing in these terms limits any right you have as a consumer that the law does not let us limit, or our liability for death or personal injury caused by our negligence, or for fraud. Otherwise, to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid for the game.
8. About Apple
You and we acknowledge that:
- These terms are between you and Subsense OÜ only, not with Apple Inc. (“Apple”). Subsense OÜ, not Apple, is solely responsible for the game and its content.
- The licence is limited to use on Apple-branded products you own or control, as the Usage Rules in Apple’s Media Services Terms and Conditions permit.
- Subsense OÜ alone is responsible for any maintenance and support of the game. Apple has no obligation to provide any.
- If the game fails to meet any warranty that applies to it, you may tell Apple, and Apple will refund the purchase price, if any, for the game. To the extent the law allows, Apple has no other warranty obligation for the game; any other claim, loss, liability, damage, cost or expense from a failure to meet a warranty is Subsense OÜ’s responsibility.
- Subsense OÜ, not Apple, is responsible for addressing any claim by you or anyone else about the game or your possession or use of it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If anyone claims that the game, or your possession or use of it, infringes their intellectual property rights, Subsense OÜ, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent and warrant that you are not in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms (such as those of your wireless data service) when using the game.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
9. Law
These terms are governed by the laws of the Republic of Estonia. If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and may bring a claim in its courts.
